By using the StrideOn website for perusal, hiring or purchasing a product from StrideOn Australia You agree to the following;
The following Terms and Conditions, along with our Privacy Policy, govern the use of StrideOn Australia and constitute the entire Agreement between the contracting parties. By using this website or placing an order either online, in person or over the phone You agree to be bound by these Terms and Conditions listed below which will be amended from time to time. Any promotional brochures, marketing material or information provided to You by Us is for information purposes only and does not form part of this Agreement.
Information is as stated on the StrideOn Australia website. Verbal opinions and recommendations provided by StrideOn employees are expressed in the interest of assisting the customer and are not legally binding or considered medical advice. We recommend that you seek medical advice before purchasing or hiring any of our products but it is Your responsibility to obtain that from a doctor before purchasing or hiring from Us. StrideOn employee’s recommendations should not be used in place of any doctor recommendations.
StrideOn Australia is not responsible nor will its employees and associates be held responsible for any injury, loss or damage to persons or property, for any reason whatsoever, in obtaining, and/or using any product rented from StrideOn Australia.
All prices are quoted in Australian dollars and do not contain any Australian Goods and Services Tax.
All product warranties for Equipment purchased are as stated whether offered by StrideOn Australia and/or the product manufacturer.
No Employee or agent of StrideOn Australia can make any amendments to this agreement oral or otherwise.
If You have a question in relation to any of these Terms and Conditions, please contact StrideOn Australia before completing any hire or purchase.
Definitions
The following definitions apply to this contract;
- “Terms and Conditions/ Agreement” means this Agreement;
- “Equipment’ means a product from the StrideOn Australia website
- “Hire Period” means the period described under the Hire Period heading within these Terms and Conditions;
- “Hirer” means the person or entity who accepted these terms based on hiring of Equipment from StrideOn Australia
- “Purchaser” means the person or entity who accepted these terms based on the purchasing of Equipment from StrideOn Australia
- “Us/We/Our” means StrideOn Australia Pty Ltd ABN 45 398 507 677
- “You/Your/Yourself/Customer” means the person or entity who accepted the terms and enters into this Agreement by way or using the website, purchasing or hiring Equipment from StrideOn Australia.
- “You/Your/Yourself/Customer” means any minor who will use the Equipment and the person or entity who accepted the terms and enters into this Agreement on behalf of any minor who will use the Equipment
Applicable Laws and Jurisdiction
StrideOn Australia is a Queensland based company and all hire contracts or purchases are subject to Queensland laws as Well as any relevant laws subjected by the Commonwealth of Australia and any legal action will commence in the court in correspondence with those laws. By accepting these Terms and Conditions there is nothing in this agreement that excludes, modifies or restricts any Australian legislation protection guaranteeing Your rights as a consumer.
Capacity To Contract
Orders can only be placed with StrideOn by persons over the age of 18 who have the capacity to enter into a contract.
Reviewing Terms and Conditions
We reserve the right to update our Terms and Conditions from time to time without notice and the order You place will be relevant to the date of Your transaction and the Terms and Conditions on this website at that time. We can be contacted for a current or previous copy to be sent if You require one.
Information On This Site
All content within this website including text, photos, logo etc are subject to copyright, trademarks and other intellectual property rights and are owned by StrideOn Australia.
You are not permitted to reproduce, communicate, distribute, sell, change or publish or use any material on this website including photos and videos for commercial purposes without prior written consent from StrideOn Australia.
The Customer Obligations Under this Agreement
You must;
- Pay the hire charge prior for every day or part thereof in the Hire Period;
- Only use the supplied Equipment (hire or purchase) only in accordance with its intended purpose and following any written instructions received.
- In the case of hiring You the authorised user follows directions in accordance with any written directions regarding its use and You do not allow or authorise any other person or entity to use, re-hire, possess, or operate the Equipment and to take all reasonably necessary steps to prevent this occurring
- You satisfy Yourself that the Equipment You have hired or purchased is suitable and fit for the purpose for which You intend to use it and that You have received advice from a medical professional to confirm the suitability of the Equipment hired or purchased. You will notify StrideOn Australia immediately if the Equipment becomes defect or unfit for purpose in anyway and to cease use of the Equipment until the product is either repaired or replaced.
- When first receiving the Equipment You as the Hirer or Purchaser ensure the Equipment is in good condition and order and if not notify StrideOn Australia immediately to advise us of the condition of the product which We may request photographic evidence to assist in resolving the matter.
- When hired Equipment is returned to Us We expect it in the same clean condition and to be in good working order apart from any fair reasonably wear and tear.
- When hiring an Orthomate You as the Hirer are responsible for looking after and maintaining the pneumatic tyres.
- This includes maintaining the tyre pressure at 25 psi.
- Fixing any damage that is not attributed to normal wear and tear. Flat tyres are not considered normal wear and tear.
Confirmation of Order
All orders placed are an offer of purchase and are subject to approval by StrideOn Australia who reserves the right to refuse an offer for a valid reason. StrideOn Australia provides products to consumers and medical professionals and reserves the right to refuse an order if it believes it is for the purpose of resale.
Payment
StrideOn Australia does not ship any goods for hire or purchase until payment for those goods has been received. Payment can be made online or over the phone.
When hiring a product from StrideOn Australia You agree to pay the hire charge for the minimum Hire Period published on the website for that product in advance including any additional shipping costs before the product is sent. For any extension to Your current Hire Period you will need to contact StrideOn Australia online or over the phone prior to the last day of Your Hire Period and will require payment upfront.
If a StrideOn Australia product is hired by You and that product is not returned once Hire Period ends and after multiple attempts to contact You without success, the Hirer agrees to pay the full list price of the item (on the website) and gives StrideOn Australia permission to charge to the original credit card. The Hirer attests to being the card holder or an authorised user of the card given to StrideOn Australia for payment.
Shipping
The customer will be responsible for accepting the delivery of the products without undue delay. If a delivery is not accepted the couriers may leave a card with instructions and possible charges could be incurred which are out of StrideOn Australia’s control.
We aim to delivery our products within the timeframes indicated but We cannot guarantee exact delivery days and times as We used a third party provider to deliver the product. We will attempt to inform You of any delays to deliveries but We will not be held liable for any losses, liabilities, costs, damages or charges which may arise from late delivery or if you consent to providing the authority to leave during the booking.
StrideOn Australia sends its products right around Australia, however there may be times when We are unable to deliver to some locations which is out of our control as We used third parties to deliver our products. If this rare occasion arises You will be informed using the contact details You provided and We will arrange a refund or an alternate delivery address with You.
You must take care when opening the packaging and not to use sharp instruments so as not to damage the Equipment. If damage occurs as a result additional charges may occur to the hire charge or result in additional charges being taken if a refund is requested.
Cancellation
Cancellations can be made within 2 days from receiving any hire product from StrideOn Australia, cancellations fees will be incurred. Please contact us via phone or email to arrange. More details can be found in our returns policy.
Hire Period
The Hire Period will commence from the time the order is in Your possession by way of delivery to the address provided or when You pick up products from our office location. The Hire Period is for no less than 2 weeks from the date You receive the product. A cancellation can be made within 2 days from receiving any hire product from StrideOn Australia, cancellations fees will be incurred. The Hire Period ends when the courier picks up the products for return or is personally delivered to the office. These Terms and Conditions are effective from the day You complete a booking and payment for hire of Equipment until We receive the items and any issues are resolved.
Ownership Of and Responsibility For The Equipment
You acknowledge that any Equipment hired through StrideOn Australia is owned by StrideOn Australia. Your rights to use this Equipment are as a Hirer only and You are prohibited to offer, sell, assign, sub-lease or charge for use of the Equipment You have hired in any way. If You choose to purchase any of the products You initially hired only once full payment has been received by StrideOn Australia will You own the right to that Equipment.
During the Hire Period, You as the Hirer are responsible for the Equipment from the moment it is delivered the requested address until the Equipment is returned to Us. This responsibility includes taking all reasonable and appropriate steps to secure the Equipment and protect from any damage, theft of use other than by You the Hirer. If the Equipment is stolen, damaged beyond normal minor wear and tear or subject to any unauthorised use, You will contact StrideOn Australia immediately to notify us and this will result in the end of the Hire Period and You as the Hirer will be responsible for full payment (as determined by StrideOn Australia) of the Equipment at no more than the advertised price excluding and shipping charges. Provided that You pay in full and replacement Equipment is required the Hire Period can start again through the online booking portal or over the phone and delivered organised once full payment is received and You will be subject to these same Terms and Conditions You initially signed.
Extending Hire Period
When You extend the Hire Period for any product You will still be bound by the original Terms and Conditions You accepted as part of the initial Hire Agreement.
Faulty Product Returns
StrideOn Australia aims to provide quality products of the highest standard to hire and purchase. If You receive a product with a fault You need to stop using the product immediately and to contact us as soon as possible so We can assist You in identifying the issue and resolving the matter. In order to assist this process, We may require You to send images of the damage, defect or fault for our initial assessment.
If the Equipment is confirmed to be faulty by Us, We will work with You to determine a resolution which could but not be limited to sending out a replacement model, parts at our discretion to try and provide the least amount of inconvenience to You. If it is decided that the product will need to be returned to the StrideOn Australia office for further investigation this will be at the cost to You if a courier is required. If the product is confirmed as faulty by a StrideOn technician this courier cost will be reimbursed to you in a timely manner no later than 7 working days after confirmation of fault and a resolution agreed between the two parties. If we send a replacement model after identifying a fault with one of our products you have hired or purchased StrideOn Australia will pay the cost of the delivery of the replacement Equipment.
If in Our reasonable opinion the Equipment following the purchase or hire becomes damaged or unworkable due to unfair wear and tear, misuse or failure to follow instructions, this will not constitute as a defect or fault. StrideOn Australia will not reimburse any courier costs sent for fault investigation if We strongly believe the damage has occurred from misuse not a faulty product.
Returns
In addition to Your consumer rights under the Australian Consumer Law You can return any new or ex-hire Equipment purchased within 7 days from receiving them. A restocking fee will apply and We will not be able to refund any courier fees that have already been paid and You will be liability for any return shipping costs. Purpose of Goods
You agree by accepting the website Terms and Conditions to only use the Equipment for their intended purpose by way of online, over the phone or in person hiring or purchasing and products that, any Equipment used outside of its intended purpose and for hire products by persons other than the Hirer will result in You assuming full responsibility for any loss or damage caused by that use. Advice and Information
The information and advice within this website is general in nature and is in no way intended to represent or replace professional medical advice for individual or specific conditions. Any advice and information contained within this website is general, while StrideOn Australia endeavours to ensure all information contained within this website is correct, We cannot be held accountable for any loss or damage arising from its use.
Disclaimer
These Terms and Conditions do not exclude or limit Your statutory rights as a consumer or StrideOn Australia’s liability under the relevant Queensland Government and Commonwealth Laws. In performing any obligation under these Terms and Conditions, StrideOn Australia’s duty is to exercise reasonable care and competency.
Intellectual Property Rights and Rebranding
You as the Customer acknowledge and agrees that You are not entitled to any intellectual property rights (including but not limited to copyright, trademarks, patents and designs) of StrideOn Australia.
Indemnity and Liability
By accepting these Terms and Conditions You indemnify StrideOn Australia and our related entities including our and their employees and owners against any and all claims including injuries, loss and damages (actual and perceived) including legal fees which arise out of Your breach of these Terms and Conditions and any relevant laws. You have adequate insurance to cover all liabilities incurred as a result in the use of the purchased or hired Equipment.
Any warranties except those within this Agreement, StrideOn Australia accepts no responsibility and will not be held liable to You for any damages, costs or other liabilities what so ever (including consequential loss) in relation to the purchasing or hiring of the Equipment by You the Customer.

When there is a link to another website, StrideOn Australia bears no responsibility for the content, security or conduct of these sites including the accuracy of any content.
Reviews / Comments/ Photos
StrideOn Australia encourages certain product reviews on this website and users may be invited to review a product. By providing this review You give permission to StrideOn Australia to use, publish, reproduce and modify which includes publishing of Your first name, town and/or state, date of review along with any photos provided in a perpetual, irrevocable, royalty-free without any compensation to You.
Any customer reviews on the website, in no way represent the views or opinions of StrideOn Australia including the owners or employees. It is the sole product from the creator.
Dispute Resolution
In the event a dispute arises in relation to the StrideOn Australia Terms and Conditions both parties agree to negotiate and work to resolve the dispute. If any dispute or differing of options arising from these Terms and Conditions that cannot be resolved the parties agree to work together with a third party such as the Queensland Government Dispute Resolution Centre Mediation.
Severability
If for any reasons any part of these Terms and Conditions becomes void or unenforceable all other areas of this agreement will be unaffected and remain in full force except for the part affected by the severance.
